01Who these terms are between
These terms are an agreement between you and Nour Arraf, Carrer de Mossèn Femenia, 9, tax ID Z0007549X — "Loyaly", "we", "us".
They cover using this website and sending us an enquiry through it. Using the site means you accept them.
02What this website is
This site describes Loyaly and lets you ask us to build a branded app for your clinic. It is not the product. The product is the app and the clinic portal, and those have their own terms, which you agree to when you are given an account.
03Asking us to build your app
The "Build my app!" form sends us a request, not an order. It does not create a contract, it does not reserve anything, and no money changes hands on this website.
We may accept or decline any request, and we do not have to give a reason. If we accept, we will contact you and agree the commercial terms separately, in writing, before anything is built.
The preview the form shows you is an illustration of how your colours, font and logo would look. It is not a commitment about the finished app.
04What you send us
Tell us the truth. You confirm that the clinic details you give are accurate and that you are entitled to act for the business you name.
The logo is yours to give. You confirm that you own it or are licensed to use it, and that letting us use it will not infringe anyone else’s rights. If that turns out not to be so, you are responsible for the consequences, not us.
You give us permission to use your logo, name and colours for one purpose: to prepare your preview and, if we go ahead, to build and operate your app. Nothing else. We will not use them to advertise Loyaly without asking you first.
Do not upload anything unlawful, anyone else’s brand, or a file meant to attack the site.
05Using the site
Read it, use the form, tell people about it.
Do not try to break it, scrape it wholesale, get around its rate limits, submit through it automatically, or probe it for weaknesses without asking us first. If you think you have found a security problem, we would genuinely like to hear about it: support@loyalyapp.com.
06What belongs to whom
The Loyaly name, logo, the design of this site and its text are ours. You may link to the site freely. You may not copy its design or its wording for something of your own.
What you send us stays yours. We claim nothing over your brand beyond the permission described above.
07No promise that the site is perfect
This website is provided as it is. We try to keep it accurate and available, but we do not promise it will be free of errors or never go down, and we may change or remove any part of it.
Prices, features and timescales described here are indicative. What you actually get is what your signed agreement says you get.
08Nothing here is professional advice
Loyaly is a loyalty and booking tool. Nothing on this site is medical, legal, tax or financial advice, and nothing here tells you what your clinic must do to meet its own obligations — including its obligations to its patients under data protection and health records law.
09Liability
We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us exclude.
Beyond that, and to the extent the law allows: we are not liable for indirect or consequential loss, lost profit, lost business or lost data arising from your use of this website, and our total liability in connection with this website is limited to 1,000 EUR.
10If a term does not hold
If any part of these terms turns out to be unenforceable, the rest still stands.
11Changes
We may change these terms. The date at the top says when they last changed, and the version on this page at the time you use the site is the one that applies.
12Law and courts
These terms are governed by Spanish law. Consumer disputes may be brought before the courts of your place of residence in Spain.
